The selection of decisions spans from 1995 through 2011 and is organized by federal circuit. The decisions are listed in the order of frequency of citation.. The most cited decisions appear higher in each section. Due to the number of opinions issued by the DC Circuit, the opinions are organized by year of publication.Congress regulates the natural gas industry primarily through the NGA, which gives the Federal Energy Regulatory Commission extensive regulatory powers over the industry, including the ability to fix rates and issue the certificates required for natural gas companies to operate. Yet, Congress deliberately chose not to regulate "the entire natural-gas field to the limit of constitutional power" but instead designated the areas to be regulated and the areas in which FERC cannot regulate. Specifically, § 1(b) of the NGA states that the Act applies "to the transportation of natural gas in interstate commerce [and] to the sale in interstate commerce of natural gas for resale . . . but shall not apply to any other transportation or sale of natural gas or to the local distribution of natural gas or to the facilities used for such distribution." Texas Pipeline Association v. FERC, (5th Cir. 2011)The Natural Gas Act provides FERC with jurisdiction over the transportation and sale of natural gas in interstate commerce. Section 7(c) requires companies to obtain from FERC a "certificate of public convenience and necessity" before constructing or operating interstate natural gas facilities. FERC may "attach to the issuance of the certificate and to the exercise of the rights granted thereunder such reasonable terms and conditions as the public convenience and necessity may require.
